Article 1 — Who are we?
The Vueko service, accessible on the website vueko.app (the “Service”), is published by:
Faycel Delli, sole trader (entrepreneur individuel, EI)
27 rue de Verdun, 92150 Suresnes, France
RCS Nanterre 819 457 375
E-mail: contact@vueko.app · Telephone: +33 6 05 81 86 30
VAT not applicable, Article 293 B of the Code général des impôts (French General Tax Code).
In the Terms, “Vueko”, “we”, “us” and “our” refer to the publisher of the Service; “you” refers to the Customer.
Article 2 — Definitions
- Professional: any natural or legal person acting for purposes falling within the scope of their commercial, industrial, craft, liberal or agricultural activity, including when preparing the launch of that activity.
- Customer: the Professional who creates an account or subscribes to an offer of the Service.
- Workspace: the workspace of the Service to which the subscription, the credits, the tracked stores and the Members are attached.
- Member: a person who has access to a Workspace, with the role of owner, administrator or member.
- Plan: the offer chosen, free or paid, as described on the Pricing page of the website.
- Credits: the units consumed by certain actions of the Service. Plan credits are included in a Plan; top-up credits are purchased separately, in packs.
- Generated Store: the online store (theme, texts, visuals, product pages, pages) produced by the store generator of the Service.
Article 3 — Customers concerned and acceptance
3.1. Service reserved for professionals. The Service is intended exclusively for Professionals, for the needs of their business, including to prepare its launch. It is not offered to consumers or to non-professionals.
3.2. Declaration. By creating your account, and then by confirming each payment, you declare that you are acting in a professional capacity, including to launch your business. This declaration is an essential condition of our commitment and you are responsible for its accuracy. If you are not acting in a professional capacity, you must not use the Service.
3.3. Acceptance. You accept the Terms by creating your account, and then by confirming each payment; a link to the Terms appears next to the account creation button and the payment button. The version you accept is kept and is sent to you by e-mail with the confirmation of your order. The Terms remain available on the website at all times.
3.4. The Terms prevail over your own purchasing terms.
3.5. The Service is reserved for persons who are of legal age and have the capacity to enter into a contract.
Article 4 — The Service
4.1. Description. Vueko is online software for the analysis of e-commerce. Depending on the Plan chosen, it makes it possible in particular:
- to search for products and online stores and to follow how they evolve;
- to consult an ad library and the analysis of stores (advertisements run, audience, estimates of advertising spend, traffic and revenue);
- to generate a Shopify store using artificial intelligence, then to deliver it to your Shopify account or to download it.
The content of each Plan (features, credits, number of seats, tracked stores) is the one presented on the Pricing page at the time of your order.
4.2. Origin of the information. The information displayed comes from public sources: ad libraries published by the platforms pursuant to the European Digital Services Act, public pages of online stores and other open sources. Vueko is affiliated with neither Meta, nor TikTok, nor Shopify. These sources may contain errors or gaps, and may change without notice.
4.3. Published facts and estimates. A figure taken as it stands from a source is displayed without any particular sign. A figure calculated by our models (revenue, traffic, advertising spend…) is an estimate: it is preceded by the sign “≈” and, where applicable, accompanied by a range. Our methods are described on the Methodology page. Estimates are indicative: they guarantee neither the actual figure of a store nor the results of your own sales or campaigns. Your business decisions are yours.
4.4. Stores analysed. Our crawler only visits public pages and complies with robots.txt files. A merchant may obtain the removal of their store by following the procedure described on the VuekoBot page.
4.5. Requirements. The Service is used with an Internet connection and a recent browser. Direct delivery of a Generated Store requires a Shopify account, taken out separately with Shopify and at your own expense.
Article 5 — Account and Workspace
5.1. Access to the Service requires an account, created with an e-mail address and a password, or with a Google account where that option is offered. You undertake to provide accurate information and to keep it up to date.
5.2. Your login details are personal and confidential. Actions carried out from your account are presumed to have been carried out by you, unless proved otherwise or unless you have previously reported an unauthorised use. Notify us without delay at contact@vueko.app if you suspect an unauthorised use.
5.3. Each account is attached to a Workspace. The owner and the administrators of the Workspace may invite Members, within the limit of the seats included in the Plan; they alone manage the subscription, the payments and the Shopify connection. The Customer who holds the Workspace is answerable for compliance with the Terms by its Members.
Article 6 — Plans, prices and credits
6.1. Free plan. It allows you to discover the Service with limited features and a limited number of credits, indicated on the Pricing page. Its content may change under the conditions of Article 12.2.
6.2. Paid plans. These are subscriptions payable every month. Their prices are indicated in euros on the Pricing page. VAT not applicable, Article 293 B of the CGI: the price displayed is the total price you pay.
6.3. Plan credits. Each paid Plan includes a number of credits per month. At the start of each subscription month, your reserve of plan credits is reset to that number: unused plan credits are not carried over.
6.4. Top-up credits. You may buy credit packs as a one-off payment, without changing Plan. Top-up credits do not expire: they remain available for as long as your account exists, including after your subscription has ended.
6.5. Use of credits. Certain actions consume credits (for example the generation of a store, of texts or of visuals). Their cost, or an estimate of that cost, is indicated in the Service before you launch the action. Plan credits are used first, top-up credits next, in the order in which they were purchased. A store generation that fails consumes no credits. Credits have no monetary value; they may be neither assigned, nor transferred to another Workspace, nor refunded, except in the cases provided for by the Terms.
Article 7 — Order and payment
7.1. Steps of the order. To subscribe to a paid Plan or to buy a credit pack:
- 1. you choose the offer on the Pricing page or on the Billing page of your Workspace;
- 2. you sign in to your account or you create one;
- 3. a summary presents the offer, its price and, for a subscription, its billing frequency; until payment, you can go back to correct your choice or your information;
- 4. you enter your billing information and you pay; by confirming the payment, you declare that you are acting in a professional capacity and you accept the Terms; the contract is concluded as soon as the payment is confirmed;
- 5. you receive by e-mail the confirmation of your order, which restates the offer and its price, together with the Terms.
7.2. Contract between professionals. As the contract is concluded between professionals, the parties agree, as permitted by Article 1127-3 of the Code civil (French Civil Code), to derogate from the provisions of 1° to 5° of Article 1127-1 and from those of Article 1127-2 of that code. The steps described in Article 7.1 are given for information.
7.3. Language. The contract is concluded in French. Translations of the Terms (in particular into English, Spanish and Portuguese) may be provided for information; in the event of any difference, the French version prevails.
7.4. Archiving. We keep contracts and invoices on a reliable and durable medium for ten years. You may obtain a copy of them on simple request to contact@vueko.app. Your invoices are also available from the Billing page of your Workspace.
7.5. Payment and invoices. Payment is made by bank card or by any other means offered, through our secure payment provider Stripe. We never have access to your card details. The subscription is paid in advance: on ordering, then every month on the anniversary date of the subscription. A credit pack is paid for in one go, on ordering. No discount is granted for early payment. Your invoices reproduce the billing information you enter (name or company name, address and, where applicable, VAT number): you are responsible for its accuracy.
7.6. Payment failure. If a payment fails, your Workspace reverts to the free plan; your top-up credits are kept. If the payment is settled within 14 days, your Plan is restored until the end of the current subscription month; failing that, the subscription is terminated automatically (de plein droit), with no sum due for the unpaid period.
7.7. Late payment. Any sum unpaid on its due date automatically gives rise (de plein droit), without any reminder being necessary, to late-payment penalties equal to three times the legal interest rate, as well as to a fixed indemnity for recovery costs of €40 (Article L. 441-10 of the Code de commerce, the French Commercial Code).
Article 8 — Term, change of Plan and termination
8.1. Term. The subscription is concluded for an indefinite term, with no minimum commitment period. It is payable monthly, in advance, and continues for as long as you have not cancelled it. A “subscription month” means the period of one month that starts on the subscription date, then on each anniversary date; a late payment does not shift it.
8.2. Change of Plan. You may change Plan at any time from the Billing page. Before confirmation, the Service shows you the effective date of the change, the amount to pay and the plan credits that will be allocated to you. Your top-up credits are always kept.
8.3. Cancellation by you. You may cancel your subscription at any time and free of charge:
- online, with the “Cancel your subscription” button accessible from the Billing page of your Workspace;
- or by e-mail to contact@vueko.app.
We confirm receipt of your cancellation by e-mail, indicating the date on which the subscription ends and the effects of the cancellation.
8.4. Effects of cancellation. Cancellation takes effect at the end of the current subscription month, already paid for. You keep your Plan until that date; your Workspace then reverts to the free plan and no new payment is taken. Any subscription month that has started is due: the current month is not refunded. Your top-up credits are kept, and the Generated Stores already delivered or downloaded remain at your disposal.
8.5. Deletion of the account. You may request the deletion of your account at contact@vueko.app. Deletion ends your subscription, without refund of the current subscription month. All remaining credits, including top-up credits, are then lost: we remind you of this before carrying out the deletion. For as long as your account exists, even on the free plan, your top-up credits remain available. Your personal data is processed as indicated in the Privacy Policy.
8.6. Suspension and termination by Vueko. In the event of fraud, of a breach of the security of the Service or of a serious breach of Article 9, we may suspend access to your account for 15 days at most, by an e-mail that states the reason. If the breach persists after a formal notice sent by e-mail, or immediately in the event of fraud or of a breach of security, we may terminate the contract; except in the event of fraud, we then refund you the unused portion of the month paid for and your unused top-up credits.
8.7. Discontinuation of the Service. If we were to cease operating the Service permanently, we would inform you at least 30 days in advance, and we would refund you the unused portion of the subscription month paid for as well as your unused top-up credits, at the price at which you bought them.
Article 9 — Rules of use
You undertake to use the Service fairly and in compliance with the law. In particular, it is prohibited:
- to extract or reuse all or a substantial part of the data of the Service, whether by automated means (bots, scripts, scraping) or manually and systematically, except by means of an access that we offer for that purpose;
- to resell, rent or make available to third parties the Service or its data, or to use them to create a competing service;
- to share your login details or to circumvent the limits of your Plan (seats, credits, tracked stores);
- to attempt to access our systems without authorisation, to disrupt their operation or to decompile the software, other than in the cases authorised by law;
- to use the Service to publish content that is unlawful, misleading or infringes the rights of third parties.
Article 10 — Third-party content, Generated Stores and Shopify connection
10.1. Third-party content. The advertisements, visuals, videos, texts and trademarks displayed in the ad library and in the analysis of stores belong to their authors or owners. They are presented for information and analysis purposes. You may not reproduce or reuse them, in particular in your own advertisements or stores, without the authorisation of their owners.
10.2. Generated content. The texts, visuals and stores produced by the generator rely on artificial intelligence models. They may contain errors or inaccuracies: reread them and check them before any publication. You are solely responsible for the content of your store once it is published, in particular for the descriptions of and claims about the products, the prices, the rights to the images you provide and compliance with the regulations. The customer reviews, ratings and statistics pre-filled by the generator are examples: replace them with real reviews and figures, or remove them, before publication. Publishing fake reviews or invented figures is a misleading commercial practice (Article L. 121-4 of the Code de la consommation, the French Consumer Code) for which you alone would be responsible. The policies and legal pages proposed for your store (returns, terms of sale…) are templates to be adapted to your situation; they do not constitute legal advice.
10.3. Shopify connection. For direct delivery, you connect your Shopify store by providing the credentials of an app created from your Shopify account (client ID and client secret) or, for an app created before 2026, an Admin API access token. You authorise us to create and to modify in that store the necessary items: theme (installed without being published), products, pages, menus and, if you have authorised it, store policies and discounts. Vueko never publishes the theme: it is you who publish it. These credentials are stored encrypted. You may disconnect your store at any time in Vueko, then uninstall or delete the app in Shopify.
Article 11 — Intellectual property
11.1. The Service (software, databases, texts, trademarks, logos, design and store theme) belongs to us or is licensed to us. We are the producer of the databases of the Service within the meaning of Articles L. 341-1 et seq. of the Code de la propriété intellectuelle (French Intellectual Property Code). For the duration of the contract, we grant you a personal, non-exclusive and non-transferable right to use the Service in accordance with the Terms.
11.2. Items delivered. For each Generated Store that you deliver or download, we grant you, for the whole world, with no time limit and at no extra cost, the right to use, reproduce, modify and exploit the theme and the content delivered (texts, visuals, product pages) for your own stores or those you create for your clients, including after the end of your subscription. You may not resell or redistribute the theme as such.
11.3. Your content. You remain the owner of the content you import into the Service (images, texts, information about your products). You warrant that you hold the necessary rights to that content and you authorise us to use it solely to provide you with the Service.
Article 12 — Availability, changes and support
12.1. Availability. The Service is in principle accessible 24 hours a day and 7 days a week. It may be interrupted for maintenance, for an update or in the event of a failure, including at our providers (hosting, data sources, artificial intelligence providers). We use our best efforts to limit these interruptions.
12.2. Changes. We develop the Service in order to improve it, to keep it secure and to adapt it to technical developments, to changes in the data sources or in the rules of the platforms, and to the regulations. These changes entail no additional cost for you. If a change has a negative impact, more than minor, on your access to the Service or on its use, we inform you of it in advance by e-mail, specifying its date; you may then terminate the contract free of charge within 30 days following that information or, if it is later, the change itself; we refund you the portion of the price corresponding to the period remaining and your unused top-up credits.
12.3. Support. We answer your questions by e-mail at contact@vueko.app as quickly as possible. The Plans that provide for it benefit from priority handling.
Article 13 — Liability
13.1. We deploy the means necessary for the proper functioning of the Service; we are bound by a best-efforts obligation (obligation de moyens).
13.2. You remain solely responsible for the business decisions you take on the basis of the information and estimates of the Service (Article 4.3), for the reuse of third-party content (Article 10.1) and for the content of your stores (Article 10.2).
13.3. Limits. Our liability is limited to direct and proven damage, within the limit of the sums you have paid us during the twelve months preceding the event giving rise to it. We are liable neither for indirect damage, such as loss of revenue, of margin, of customers, of data or of reputation, nor for interruptions of or changes to third-party services beyond our control, such as Shopify or the advertising platforms. These limits do not apply in the event of gross or intentional fault, or in the event of bodily injury. You indemnify us against any claim by a third party resulting from a breach on your part of Articles 9 and 10.
13.4. Force majeure. Neither party is liable for a breach caused by an event of force majeure within the meaning of Article 1218 of the Code civil.
Article 14 — Personal data
We process your personal data in accordance with our Privacy Policy, accessible on the website. It sets out in particular the purposes of the processing, the recipients and processors, the place where the data is hosted, the retention periods and your rights.
Article 15 — Changes to the Terms and to the prices
15.1. We may amend the Terms to follow changes in the law, in a decision of an authority or in the third-party services on which the Service depends, without affecting the content or the price of your Plan, which fall under Articles 12.2 and 15.2. We inform you of this by e-mail at least 30 days before the new Terms come into force. If you refuse them, you may cancel free of charge before that date; the previous Terms then apply until the end of your subscription.
15.2. We may change our prices. For a current subscription, a new price applies only from the first monthly payment occurring at least 30 days after we have informed you of it by e-mail. If you refuse it, you may cancel free of charge before it applies. The price of a current subscription month or of a pack already purchased never changes.
Article 16 — Complaints
For any complaint, write to us at contact@vueko.app or by post to the address indicated in Article 1. Before any legal action, we invite you to send us a written complaint so that we can seek an amicable solution together.
Article 17 — Governing law and disputes
17.1. The Terms are subject to French law.
17.2. Failing an amicable agreement, and if you have the status of a trader (commerçant), any dispute relating to the Terms falls within the exclusive jurisdiction of the courts of Nanterre.
Article 18 — Miscellaneous provisions
18.1. If a clause of the Terms is declared void, the other clauses remain applicable.
18.2. The fact of not relying on a clause does not amount to a waiver of the right to rely on it later.
18.3. We may transfer the contract to any person who takes over the operation of the Service, for example a company that we might create, without any reduction of your rights; you are then informed of it by e-mail.
18.4. The Terms, the Pricing page in force on the day of the order and the Privacy Policy form the entire agreement between the parties.
